Eligibility By using the Site, you represent that you are at least the age of majority in your jurisdiction of residence, or that you have given us your consent to allow any of your minor dependents to use this Site.

Modifications to the Terms We reserve the right to update, change, or refine any part of these Terms by posting updates to our Site. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.

2. Intellectual Property Rights (IP)

Ownership & Stewardship The Site and its entire contents, features, and functionality (including, but not limited to, design narratives, archival photography, technical drawings, branding, and the design, selection, and arrangement thereof) are the exclusive property of Aftab Gallery, its licensors, or the creating artists. These assets are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Rights Regarding Physical Works The acquisition of a physical work from Aftab Gallery transfers title to the physical object only. It does not grant the collector any right to reproduce, reverse-engineer, scan, or create derivative works based on the design. All design rights remain the perpetual property of Aftab Gallery and the creating artist.

Limited License You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any of the material on our Site without express written permission.

3. Acquisition & Commission Terms

Valuation & Availability All valuations and availability of works on the Site are subject to change without notice. We reserve the right at any time to modify or withdraw any work from the collection. While we strive for archival accuracy, descriptions of provenance, dimensions, or material specifications are subject to revision.

Bespoke Commissions Specific terms regarding payment schedules, production lead times, material approvals, cancellation, and returns for Bespoke Commissions are governed by the separate Commission Agreement issued at the time of deposit. In the event of a conflict between these Site Terms and the Commission Agreement, the Commission Agreement shall prevail.

Global Logistics & Risk Shipping costs are calculated based on destination and service level (Secure Crated Freight or Premium White-Glove). Risk of loss and title for works pass to the collector upon our delivery to the carrier (FCA/Ex Works terms, unless otherwise specified). For international acquisitions, the collector is the importer of record and is responsible for all local duties, VAT, and customs clearance.

4. Disclaimers and Limitation of Liability

Disclaimer of Warranties Your use of the Site is at your sole risk. The Site is provided on an “as is” and “as available” basis. Aftab Gallery expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability In no event shall Aftab Gallery, its directors, employees, partners, agents, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, use, or goodwill, resulting from (i) your access to or use of the Site; (ii) any conduct or content of any third party on the Site; or (iii) unauthorized access, use, or alteration of your transmissions or content.

5. Governing Law and Dispute Resolution

Governing Law These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.

Jurisdiction You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be exclusively brought in the courts located in Istanbul, Turkey, and you irrevocably consent to the jurisdiction of such courts.
